Both REACH
and CLP Regulations modify Directives EU 67/548/EEC (Dangerous Substances
Directive) and 1999/45/EC (Dangerous Preparations Directive) -
that will be permanently repealed on June 1, 2015 - and consequently their
national transposition laws (DLgs 52/1997 and DLgs 65/2003) which today represent
the reference standard for the classification and labeling of chemical
substances and preparations.
The REACH (Regulation
EC no. 1907/2006) concerning the management of the products through a system of
registration, evaluation, authorization and restriction of the substance, while
the CLP (Regulation EC no. 1278/2008) aligns existing EU legislation to United
Nations GHS (Globally Harmonized System) as the system of classification,
labeling and packaging of substances (and mixtures).
Also new
responsibilities for the employer and repercussions on the approach to
prevention system for those activities that include the use of chemical agents come
from the changes and from the new complexities introduced by both Regulations and
by their effects on social legislation - including laws on occupational health
and safety (DLgs 81/2008).
I due Regolamenti REACH e CLP modificano le Direttive 67/548/CEE (Direttiva Sostanza Pericolose) e 1999/45/CE (Direttiva Preparati Pericolosi) – che verranno abrogate definitivamente al 1° giugno 2015 – e conseguentemente le relative leggi di recepimento a livello nazionale (DLgs 52/1997 e DLgs 65/2003) che ad oggi rappresentano la normativa di riferimento in materia di classificazione e l’etichettatura delle sostanze chimiche e preparati.
Il REACH (n. 1907/2006) riguarda la gestione dei prodotti attraverso un sistema di registrazione, valutazione, restrizione e autorizzazione della sostanza, mentre il CLP (n. 1278/2008), applicazione a livello dell’Unione Europea del GHS (GLobally Harmonized System) riguarda il sistema di classificazione, etichettatura e imballaggio delle sostanze (e miscele).
Dalle modifiche e dalle nuove complessità così introdotte e dalle loro ricadute sulla normativa sociale – tra cui la normativa sulla sicurezza del lavoro (DLgs 81/2008) – derivano anche nuove responsabilità per il datore di lavoro e ricadute anche sull’approccio al sistema di prevenzione per quelle attività che comprendono l’utilizzo di agenti chimici.
